TERMS AND CONDITIONS OF PURCHASE AND SALES FOR PKU.NO

1. GENERAL

These terms of purchase and sale, together with your order and an order confirmation, constitute the contractual basis for your purchase in the online store pku.no. The agreement is also supplemented by relevant legal provisions that regulate the purchase of goods between traders and consumers, including the Consumer Purchase Act, the Right of Withdrawal Act, the E-Commerce Act, the Marketing Act and the Personal Data Act. In the event of any conflict, these terms of purchase and sale take precedence, unless it conflicts with mandatory legislation.

The age limit for making purchases on credit is 18 years.

3. ORDERING AND CONCLUSION OF AGREEMENT

The purchase is binding from the moment you have sent the order and it has been confirmed registered. You will then receive an order confirmation by email with an overview of the order. You should read the order confirmation carefully and ensure that it matches the buyer's order.

If an ordered item is out of stock or cannot be obtained for other reasons, pku.no reserves the right to change your order. In such cases, pku.no will contact you and recommend alternative products.

4. PRICE AND SHIPPING CHARGES

The prices stated on the website at any time apply when ordering goods. The stated price includes VAT and other relevant costs. However, shipping costs are additional. Shipping costs depend on the selected shipping option, destination and volume or weight.

In the event of significant typing or printing errors, pku.no may delete or reject this part of the order. This applies even if you have received an order confirmation.

The stated offer prices are valid for the specified time period or as long as the item is in stock.

5. PAYMENT

PKU.no can accept payment via invoice, Visa or Mastercard. If you have any problems with payment, please contact pku.no at kundeservice@pku.no, or tel. +47 40 61 71 70.

6. SALES MARGIN

PKU.no has a sales lien on (retention of title to) the delivered goods until the purchase price plus interest and costs has been paid in full, cf. the Norwegian Mortgage Act § 3-14, cf. § 3-22.

7. SHIPPING AND DELIVERY

PKU.no ships goods to addresses throughout Norway.

Estimated delivery time is 1–7 working days depending on the chosen shipping option and the distance between our warehouse and the destination. Delivery of goods takes place in the manner specified on the order confirmation. Delivery is deemed to have occurred when you, or someone on your behalf, has physically received the goods in your/their possession. Pku.no has the risk for the goods until delivery has taken place.

As soon as you have received the goods, you should check whether the delivery matches the order confirmation and that the goods are in order.

8. COMPLAINT

If the delivery does not comply with the accompanying delivery note or the buyer discovers or should have discovered a fault or defect in the goods, he or she must notify/complain within a reasonable time. The complaint must state what kind of fault or defect is alleged.

Pku.no's liability for defects follows the provisions of the Consumer Purchase Act. If there is a defect according to the law, pku.no has the right to offer correction or replacement. If pku.no provides such correction or replacement in accordance with the Consumer Purchase Act, a price reduction or cancellation of the purchase cannot be claimed.

Pku.no assumes responsibility in accordance with the legislation in force at any time, but does not assume responsibility to a greater extent than that which results from the legislation in force at any time.

Pku.no is not liable for direct or indirect losses incurred by the buyer due to force majeure events, including strikes, lockouts, war, fire, natural disasters, interruptions in the supply of telecommunications services or electricity, etc. The purchase may be cancelled in whole or in part if such conditions are of a permanent nature. If the force majeure events are of a temporary nature, both parties may request a postponement of the delivery time.

9. THE RIGHT OF CANCELLATION LAW

Unless the purchase is exempt from the right of withdrawal, you can cancel the purchase of the item in accordance with the Right of Withdrawal Act. This means that you can withdraw from the agreement if you notify us of this no later than 14 days after you received the item. The deadline includes all calendar days. If the deadline ends on a Saturday, public holiday or bank holiday, the deadline is extended to the next business day.

If you order the product with a delivery method other than the cheapest standard option we offer, you will be invoiced for postage, even if you choose to exercise your right of withdrawal.

When exercising your right of withdrawal, please use the withdrawal form that you will receive with your order or contact kundeservice@pku.no.

When exercising the right of withdrawal, the goods must be returned to pku.no without undue delay and no later than 14 days from the date of notification of exercise of the right of withdrawal. Pku.no has the right to withhold payment received until we have received the goods in return, or until you have provided documentation that the goods have been returned.

The right of withdrawal requires that you as the customer bear the costs yourself (cf. the Right of Withdrawal Act, Section 8, Section 1). Direct costs include shipping or transport costs, and other direct costs such as purchasing new shipping packaging.

The right of withdrawal does not apply to:

  1. Goods that cannot be returned in approximately the same condition and quantity, and where damage or deterioration is due to negligence or lack of care by the consumer.
  2. Goods where the delivery itself has meant that they cannot be returned.
  3. Goods that quickly deteriorate physically.
  4. Pharmaceuticals and medical devices.
  5. Products sealed for hygienic reasons, where the seal has been broken.

10. PROCESSING OF PERSONAL DATA

In order to complete your purchase, we need to process certain information about you. Below we describe which personal data is stored and the purpose behind the processing:

  • Name and address information: Used for shipping purposes in connection with ordering goods.
  • Telephone / email: Used to contact the Buyer in connection with processing orders.

We also draw your attention to your right to access the personal data we process, and that you can request that it be deleted at any time. If you would like more information about this or to have your data deleted, please contact our customer service.

Pku.no does not pass on information to third parties in any way, except to public authorities. The data provided when registering as a new customer is confidential, and employees at pku.no are subject to a duty of confidentiality.

All activities at pku.no are automatically recorded in a log file. The log file is only used for anonymous statistical purposes (number of visitors, hits, etc.).

11. SECURE ONLINE SHOPPING

Payment by credit card is safe and easy. You enter your credit card number, expiration date and a verification code (CVV2). We work with Klarna. This means that you can be sure that your personal data will not be lost. Your credit card number is not made available to the online store. All communication is encrypted. Trading takes place in the same, proven way in all stores that offer Klarna.

When you place an order with us using your credit card, an authorization is made on your credit card. This means that we, via Klarna, check that the card is genuine and that there is sufficient funds on it. We then make a reservation, where the amount you are shopping for is reserved for its use. It is only when we have finished packing the goods and have prepared the package for shipment that the money is transferred from your credit card to us.

12. CHOICE OF LAW AND JURISDICTION

The agreement is subject to Norwegian law. Disputes between the parties shall be resolved through negotiations. If negotiations do not lead to progress, the matter may be brought before the Consumer Disputes Committee or the ordinary courts. The proper venue is Oslo District Court. Pku.no will follow the Consumer Disputes Committee's decisions in the event of a dispute.

13. INFORMATION AND EDITORIAL CONTENT ON THE WEBSITES

Pku.no does its utmost to ensure that the information on our website is correct and up-to-date. Product images may differ slightly from the actual appearance of the product.

Information on our websites is covered by the Copyright Act and may not be copied or reproduced without pku.no being cited as the source. Advice, articles and information on pku.no cannot replace professional help for serious illness. Our descriptions of illnesses, symptoms and conditions cannot be considered a consultation with a doctor. We do not accept responsibility for the incorrect use of our products. The products should always be used as stated in the package leaflet or recommended by a pharmacist/doctor, regardless of information on our websites. Always read the package leaflet carefully before using medicines. If you have long-term or recurring symptoms, or are in doubt whether you have a serious illness/disease, contact a doctor. In the event of life-threatening conditions, call 113.

14. UNCOLLECTED GOODS

Uncollected packages will be charged a minimum fee of NOK 300 to cover our expenses for packing, picking, packaging and shipping/return of the current order.
